ATTENTION: These Terms & Conditions have been updated to ensure compliance with all provisions of the Ohio Revised Code, Chapter 4707 (Auctioneers Law). By registering to bid or placing any bid, you agree to be bound by the following terms.

1. Licensing and Regulatory Compliance

1.1. Licensed Auction Firm and Auctioneer:

  • This auction is hosted and managed by BGR Auction, a Licensed Ohio Auction Firm, and conducted by a Licensed Ohio Auctioneer (License No. 2023000088]).
  • All auction firms and auctioneers posting on BGR Auctions are licensed and bonded in favor of the State of Ohio as required by law. The contact phone number for the specific licensed professional responsible for this auction is listed on the auction page.

1.2. Regulatory Body and Complaint Process:

  • BGR Auctions and its licensed professionals are regulated by the Ohio Department of Agriculture.
  • Auction Recovery Fund Disclosure (O.R.C. § 4707.25): An aggrieved individual may initiate a claim against the Auction Recovery Fund as a result of a Licensee's actions.

2. Bidding and Contractual Agreement

2.1. Bidder Registration and Responsibility:

  • All bidders must register and will be issued a unique Bidder Number and Password. The registered bidder is held responsible for ALL bids placed under their number. Do not share your bidder information.
  • Placing a Bid/Max Bids: Once submitted, a bid is a legally binding offer to purchase. Bids cannot be retracted or reversed after the auction closes.
  • Bidding Errors: If you make a bidding error (e.g., self-bidding, typo), you must IMMEDIATELY contact the Auction Firm/Auctioneer using the provided contact number to request a deletion.

2.2. Buyer's Premium:

  • A 15% Buyer's Premium will be added to the final accepted bid (hammer price) on all purchases to establish the total purchase price. This is a common industry practice to cover necessary operating and software costs.

2.3. Bidding Disputes:

  • The licensed Auctioneer shall settle any and all bidding disputes, and the Auctioneer's decision is final.

3. Payment, Funds Handling, and Default

3.1. Payment Terms:

  • Accepted forms of payment include Cash and Credit Cards.
  • Credit Card User Fee: Effective January 1st, 2025, a 4% user fee will be assessed to all payments made using a credit card within our bidding system.
  • Sales Tax: Applicable Ohio Sales Tax will be collected unless a valid State Sales Tax Exemption Certificate is provided prior to bidding.

3.2. Deposit of Auction Proceeds (O.R.C. § 4707.024):

  • All auction proceeds are required by law to be deposited within 72 hours of the auction closing into the Auction Firm's designated trust or escrow account until final disbursement.

3.3. Invoice and Payment Due:

  • Invoices are typically sent immediately after the auction closing but may take until 9:00 AM the following day. It is the bidder’s responsibility to locate their invoice (including checking spam) and determine the pickup location and time prior to the end of the scheduled pickup window.

3.4. Default and Loss of Bidding Privileges:

  • If an item remains unpaid after 24 hours of the scheduled auction pickup ending, the account will be disabled, and bidding privileges will be suspended.
  • To restore bidding privileges, the bidder must pay 35% of the total invoice and place a credit card on permanent file for automatic charging of future purchases.

4. Property Condition, Removal, and Loss

4.1. Condition of Items ("AS IS, WHERE IS"):

  • All items are sold "AS IS, WHERE IS," with NO WARRANTY expressed or implied by the Auction Firm or Auctioneer. Pictures and descriptions are for assistance only. Bidders must contact the Auction Firm to ask questions or request a preview if they are uncertain of an item's condition or use.
  • SHIPPING: Bidders must call the Auction Firm/Auctioneer to confirm shipping is available for specific items before placing a bid.

4.2. Removal and Abandonment:

  • Pickup Dates and Times: You must read and strictly adhere to the scheduled pickup date and time. Access to items may only be available within that limited timeframe.
  • BRING WITH YOU: Bidders are required to bring their own packing material, boxes, tools, and sufficient vehicle space and loading assistance for all heavy or bulky items.
  • Loss of Items/Abandonment: Any item not picked up within the designated date and time frame will be considered abandoned.
    • If the items are unpaid, your account will be disabled.
    • If the items are paid, the purchaser will lose the items, and NO REFUNDS or chargebacks will be granted due to a lack of removal.
  • Right to Resell/Dispose: The Auction Firm or Auctioneer retains the right to resell, remove, store, or dispose of unclaimed items at the expense and risk of the purchaser. The bidder agrees to pay all deficiencies, legal, collection, transportation, and storage expenses associated with delinquent accounts or abandoned items.

4.3. Auction Management:

  • The Auction Firm retains the right to extend, delay the end, or change the time and location of any auction due to unforeseen factors (e.g., severe weather, civil emergencies, or other events).
